"The County Commission is not funding the Sheriff to carry out his duties in the Town of Malabar in a responsible manner. The County Commission is obligated to provide for two or three general fund deputies, or whatever the Sheriff says he needs for the south precinct, so that he can carry out his obligation to the Town of Malabar. The property owners in Malabar pay almost one million dollars to the county general fund. What do we get from the county for that money? It is time for the County Commission to step up to the plate and meet their obligations."

According to State law, the Sheriff must respond to calls in Malabar and there is no requirement that Malabar pay for it. The Sheriff has stated that if Malabar does not pay the MSTU tax, he could stop using MSTU deputies in Malabar and respond with general fund deputies. The County Commission has threatened the Town of Malabar with a lawsuit if the Town Council does nothing although legal opinion from our Town attorney says such a lawsuit would have no basis.
