I sent a letter to Discover (requiring signature upon receiving) and they basically gave me my money back right away. So happy with Discover. As previously reported, I also signed a release so I can't disclose the details.  Suffice it to say that even after waiting over 2 years to file in small claims court, I am VERYpleased. Please, just file.  It was MUCH easier than I ever thought it would be. (FYI, I have kept my account in good standing all this time by paying a substantial minimum monthly payment to Amex...like having a second car)
(BTW, the amount listed is the total of a few transactions, so I just filed for the most expensive one that was under my state's limit.) Very basic, like 2 sentences.  What the form says does not appear to have any effect on the outcome.  Just make sure to include enough information for Amex to identify you/your account.  I made sure to not even mention any dates in my filing since it was so late and I had no problems.  Good luck to all and this is proof that it is NOT too late.

View the details of this row. Capital One VISA (Cyberized Card) 1600.00  1600.00  I made phone calls about two of my 5 orders ($1600 total), but I never filled out the dispute papers. I received the run around by the person who was hired to deal with only CR issues. She stated that I had to write on the dispute papers that I bought the products only because of the rebate and kept repeating that. I explained that the merchandise was defective (as covered under the cyberized card guidelines and protections, which I quoted to her over and over) and that that was the reason why I wanted my refund since I was unable to return the products to CR after numerous attempts to contact them. As I stated, I never completed the paper work and was just going to swallow the loss. To my surprise, in April '02, I received a letter stating that $1600 was credited to my account. You can imagine that I was a happy camper. We were looking around to dump the Capital One VISA card. Thanks for your support. Best wishes to those still fighting this. I disputed the cyberrebate charge as soon as my statement came end of may last year.  AE denied me 7 times!!!  Finally filed in small claim court and settled with them.  Got the check today, exacty 1 year and 1 week to get this whole thing settled.  Didn't ask for interest on the credit card, only $3, but asked for $10 small claim filing fee.  Very happy that it is finally over, even though this is small amount compared with some other people.

  • I disputed charges immediately following the CR bankruptcy via phone and US Mail. Later, Fleet contacted me and asked for all supporting evidence (receipts, rebate forms, etc.) to be faxed to them.
  • The investigation seemed to take a bit longer than was originally told, but it completed in my favor. Various red tape within Fleet held up getting us our check (the amount was too high?), but it was eventually refunded to us.
  •  In short, I am a very happy customer of Fleet MasterCard!
Never received rebates (and thus, inferior quality of merchandise for purchase price without a rebate)

  • I disputed charges immediately following the CR bankruptcy via phone, web site and US Mail.
  • These disputes were followed by letters stating they "could not help because the merchant was bankrupt" and the infamous (illegal?) letter stating "the rebate is a separate transaction and is not covered".
  • This went on for a long time. Thanks to Jim in FL and lots of other CRRA members, small claims looked like the answer.
  • The first suit was settled of court (non-disclosure agreement).
  • The second suit was settled out of court (non-disclosure agreement) even though my small claims case was "dismissed because of insufficient evidence" to warrant my claims.
  • Although all were settled out of court, I would have preferred to have all of these issues resolved through the regular dispute process as other credit cards have done.

All transactions totalling $3,590.58 were from Dec-Jan, definitely outside the 60 and 120 day windows. Sent original dispute letter 5/24, claiming:
1) "Billing Errors"
2) "Quality of Goods not commensurate w/ price charged"
3) ""Claims and Defenses"
Ultimately, however, I was notified of the specific wording and items required to suplement my original dispute package. After sending suplemental letter containing their requirements, I received credits for all disputed charges. In addition, they credited me (without my request) approx. $250 in finance charges related to the dispute.  Currently waiting for the 45 day 'rebuttal' period other people have written about.  Have been extremetly pleased with all CSR's I've had contact with at MBNA, and if credits stick, will only use Mastercard and especially MBNA in the future.

$12824.03, I guess everything is final, as I was going to be rebilled for $8700.00. I had lots and lots of phone calls with all perm. credits, then not perm. credits, etc, then going to be rebilled. Wrote mega letters stating "I do not accept the stale charges of over 8 months ago, and the charges will be unauthorized by me" (from Howard Strongs book).
Also I thank Reagan Lynch for his help with this.
He is the one who helped me contact the OCC to investigate Citibank. Sent my info to them and they forwarded to Citi. Just received a letter from OCC stating Citi gave me a "Goodwill Gesture" and the disputes are closed. Merchants bank never picked up their money within 45 days.

Filed standard billing inquiry investigation form from back of statement claiming I did not receive merchandise (not the merchandise I was expecting anyway i.e., the rebate) around May 2001.  Purchases were from Jan, Feb, and March 2001.   Received inquiry form from them indicating they were investigating entire Cyberrebate issue around July 2001.  I sent a certified mail request to Cyberrebate (after Chp 11) requesting return authorization.  Letter came back.  Indicated on cc investigation form what I had done to attempt return, that I had not received merchandise, and that I had called the company within 30 days of receiving order to inquire about return if I did not receive rebate.  Received full refund (> $3000) in August 2001.  Has not been recharged or anything like that.

I filed accidentally against Visa USA, Inc.  for $4,000 and before I had a chance to correct the filing.....guess who came a calling!!!  Can't say the outcome  but I was asking for interest, mailing fees, court costs on top of the charges.  NOTE:  Some of the charges were "still in dispute" but I was just tired of it all and added them to get closure.  The lawyer said "you can't file against charges we haven't made to you, they aren't ripe for adjudication".....but guess what!!!!!  .  Again, can't say.....just file, file, file and it will be your happy day....

I had five charges -- ranging from $150 to $2500 -- on my Citibank Platinum Aadvantage card.  I disputed all five, and CyberRebate's bank only challenged one (the $2500 one of course).  Evenutally that one was resolved in my favor, as the other four had been.
The rebates, which I did not receive, were part of the advertised service, so the merchant failed to fulfill the purchase agreement.

View the details of this row. National City Visa     About in July,. 2001 I mailed a dispute letter to National City  Visa. I received al letter around  August stating it would be investigated. In September I received another letter stating I would received credits for $3000.00 even though I had paid the balance off. I requested a check for this amount and it was sent to m. Just around December 15, 2001 I received a call and they said the merchant bank had disputed the chargeback and that it was not a done deal yet. They said I may have to return the merchandise. Just last week., Monday, Jan. 7, 2002 I received a telephone call from the dispute dept. again and they were very happy to inform me that they had won the case for me and my credits were permanent and the dispute was final. I was not given any details regarding the basis of the decision -- simply that it was a permanent credit, and the dispute was closed. Discover credited me for all 11 of my purchases July 2, then reversed the credits July 18th.  Then in August, I contacted Mark Vives who credited all the charges from April 1st and newer (4 of them).  I waited about a month, then had them send a check for the balance (I had not used my card since June).
For the remaining 7 charges - I took Discover to small claims court, and WON!  See Small Claims Court Case WON against Discover!!! for full info.  Discover did claim in court that those 4 credits given to me in August would have been reversed, but they never had the chance before I asked for a check (that makes me feel bad - NOT!)

View the details of this row. MBNA Platinum Plus Mastercard 4500.00  4500.00  MBNA was very helpful during this entire process (since May). They credited my account in July and sent me a check. Cyberrebate responded once and they requested a little more information from me. I faxed that out and they left the credit on the account. A couple of weeks ago, a Cyberrebate dispute rep. called me and told me that my credits were permanent as of Sept 17 and they could not and would not be reversed at any time for any reason. The dispute did not go to arbitration and the purchases were from Feb. to Apr. I think this was so streamlined because of Mastercard (MBNA told me that they were following MC directives the whole time) and they never questioned the age of the charges. I used exact wording that MBNA gave me, including invoices stating "Final Price: $0.00". I also sent website printout showing that they were not accepting returns. REB 12/19/2001

Disputed charges in May.  Merchant responded that charges were valid and then amounts were resubmitted by Capital One.  No response from the merchant bank for over 60 days.  I received a letter stating that my temporary credits are now permanent!  Capital One has been very nice and extremely helpful.

I got a letter from Capital One on November 15 stated that all my dispute with CyberRebate.com was settled at my favor (over $10200) and all thefinance charge was credited back to my account. I got a check for the balance credit yesterday. Also some of my dispute orders were over 60 day limit. I will scan my settlement letter later.
On May, I followed the instructions from Capital One and returned all the dispute merchandise to CyberRebate.com's warehouse in Ohio. On about May 22, I contacted CyberRebate.com by email to initiate the dispute based on the defect of all the merchandise in all orders (about 14). Along the process I always kept records of correspondence with Capital One (when, where, who, employee ID I talked to over the phone or mails). I just paid the minimum balance and left the finance charge to build up (about $300 thanks for 9.9% finance charge rate from Capital One).

I contacted them in late May and said that I had been defrauded in terms of the rebate (I wasn't particularly aware of the argument againstthe rebate per se) and Chase credited me within about two months.)   Chase made me a life-long member with that.

After about 6 month of dispute with about 50 pages ofdocumentation, I finally received a check from them for the full disputed amount of over $5,000!!  It's like a dream come true!  SHELL MASTERCARD IS GREAT!!!!  If you don't already have it, get it!  You get 1% back on all purchases to use towards Shell gasoline.  Better deal than most rebate and airline miles cards.  GET YOUR SHELL MASTERCARD TODAY!!!!

Made one purchase in December 2000 of about $4,000.  Received rebate checks just before CR filed for bankruptcy, and of course all the checks bounced.  I disputed the purchase with Citibank in writing immediately thereafter.  Citibank asked me to fill out one additional form stating that I couldn't return the items because the merchant was not accepting returns, and then soon after that gave me conditional credit for the purchase.  My dispute went to VISA arbitration, and the conditional credit became permanent in early December when I received a letter stating that VISA ruled in my favor.
Rebates were an integral part of the purchase agreement and were not delivered as agreed (billing error).

After further research, we are able to confirm that your account is due this credit. A ruling was made in your favor based on the fact that you, the cardholder, were able to provide sufficient detail and documentation to support the claim as valid and reasonable. The merchant failed to adequately support their position on the matter or prove that the dispute was unreasonable. Please be aware that this has been resolved through the bankcard systems and the merchant is prohibited from rebilling your account for this transaction. However, at this time since the ruling was in your favor and you have received full credit for the transaction, the merchant may elect to pursue other avenues of recourse available to them to recover the funds. [what other "avenues of recourse" ???] We thank you for allowing us the opportunity to assist you in this matter. It is always a pleasure to service valued cardholders such as you. Rebate was offered not by manufacturers but by CR itself; return of money was an integral and unique component of the purchase contract as was equivalent to promised merchandise or services. Inferior quality merchandise, tried to return them through certified mail asking for RMA #. No response from merchant, certified mail returned as refused. sent copies of all to citibank along with a copy of the advertisement on their website promoting CR. never mentioned anything about the rebates. Great service by Citibank. I owe a lot to them for my stupidity. Lesson well learnt. Thank god it had a nice ending.

View the details of this row. Nextcard Visa Platinum (eBates affinity) 18000.00  18000.00  I was getting no where with Nextcard, at first, until Visa dictated how they could dispute the transactions. I even got a 'form letter' denial inJune. Getting a hold of their customer service was difficult at first as well. However, I did get credited back in the end, so I will not cancel their card (I will wait another couple months before I use it again though, just to be sure). I just wish they had been more responsive in the beginning so I could rave about using the 'Internet Card'. From the get go I disputed on the grounds that the transaction was incomplete as I had not gotten my promised rebates. I compiled and overnighted my dispute on May 17th. I had made my purchases late January thru Mid April, and paid off my CC balances in full (by transferring the charges to my Yahoo Visa with is 1.9 introductory rate). I was credited almost 18k by Nextcard Mid August and immediately had then cut me a check for the Credit on my account. At this point I am told that it is beyond the time frame (actually end of September), for the issuing merchant bank to try and dispute my chargeback. As a side note, I was fortunate not to have used my Discover card for any of these purchases, although the friend who had introduced my to Cyberscam is still out $2000 (He used Yahoo Visa for his other purchases and has been credited back for those. His Rebates from the prior year had already been deposited). I had been a member of Discover for 13 years before canceling my account with them (I have had 6 phone calls from Discover asking if I would come back… you would think they would get tired of me ranting in their ear… and I think they aren't allowed to hang up until I am done talking J ) I do believe that it is the issuing bank (Cyberscams merchant bank) that should take it in the shorts in cases like this. The merchant bank didn't seem to mind collecting the transaction fees for every purchase… also, perhaps the Merchant bank will now do a bit more 'Due diligence' before issuing someone a merchant account. Lord knows from the consumers point of view they looked legitimate after a couple of years in business and word of mouth of rebates being paid. They would have access to the companies books, the consumer does not. Of course, in Discover and Amex cases… THEY are the issuing banks and should be the ones to eat the charges. Of course, they also enjoyed all the transaction fees… and should also do their due diligence to ensure the merchant is viable. From everything I have read, I think most of my Internet related purchases will now be made with a local Credit Union Visa. They seemed to be the most responsive in this situation. Promised Rebates not received. Had to show proof from Cyberrebates website that they had received all the rebates (marked completed). Received standard checkmark form, check goods/services not received. Aug 1 permanant credit but vendor had 45 days to respond. No response was provided and the credit was made permanant ~9/15. As of 10/9 no chargebacks or reversals. I have canceled the card to prevent recharges. If things are clear after 1 year, will reactive with this company. Three separate charges of 3000, 1800, and 200. All handled as a single claim. MAY GOD HELP THE OTHERS WHO HAVE BEEN HARMED BY THESE CROOK Goods/service not received.
