SHAGear™ will be responsible for acting only on those instructions sent to us that actually are received. We do not assume responsibility for malfunctions in communications facilities not under our control that may affect the accuracy or timeliness of any orders you send. SHAGear™ is not responsible for any losses or delays in transmission of orders arising out of the use of any Internet Access Service Provider or caused by any browser software or any computer virus or related problem that may be attributable to services provided by any Internet Access Service Provider. We are not responsible should you give incorrect instructions, approve to print a job or if your credit-card payment is not processed by your credit-card company.
The information and materials contained on the website www.shagear.com and its sub-pages, including text, graphics, links or other items, are provided "as is", "as available". SHAGear™ does not warrant the accuracy, adequacy or completeness of the information and materials on the Site and expressly disclaims liability for errors or omissions in this information and materials. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose or freedom from computer virus, is given in conjunction with the information and materials.
In no event will SHAGear™ be liable for any damages, including without limitation, direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if SHAGear™, or representatives thereof, are advised of the possibility of such damages, losses or expenses.
All logos, embroidered or screened are the sole property of SHAGear™ and can not be reprinted or used without permission from SHAGear.

All purchases are final – returns are only allowed with permission from SHAGear™. Please contact Max @ mmadrin@hotmail.com for information on returns.
SHAGear™ fully backs all merchandise against defects in workmanship.
Payments are accepted for orders in the form of Cash, Personal Checks, Cashiers Checks and PayPal. SHAGear™ reserves the right to only accept certain types of payments. Shipment may be held until personal checks clear the bank. There will be a $20.00 fee for returned checks.
Privacy
SHAGear™ does not release any information on our customers to any third parties. We do not sell or release information concerning your visit to our website. We do collect the information that is sent to us via e-mail for later contact by SHAGear™ only concerning future product releases. You may at anytime requests that you be removed from the e-mail list and no future e-mails will be sent to you. Address and Telephone numbers sent to us while ordering products will only be used in the order process. All information will be kept confidential. Orders placed through PayPal are secure and credit card numbers are not released to SHAGear™ by PayPal.
Indemnity
You agree to defend, indemnify and hold SHAGear™ and its affiliates harmless from and against any and all claims, damages, costs and expenses, including reasonable attorneys' fees, arising from or relating to your use of SHAGear™ website and the Service, your violation of this Agreement, or your violation of any rights of another.
Taxes
Taxes for internet orders will be collected at the rate of 7% for all orders shipped to the State of North Carolina. SHAGear™ is a registered business in the State of North Carolina and the city of Greensboro, NC.
Shipping
SHAGear™ will determine the best means to ship items. Prices quoted for shipping are based on ground shipment. Shipping prices are for orders in the Continental USA only. A Shipping confirmation will be obtained for each package sent. SHAGear™ is not responsible for incorrect address information. Shipments outside of the Continental USA will be based on the destination and can not be determined until SHAGear™ is contacted prior to the order.
