Here's another example of an ERISA plan getting off the hook by way of a remand. In Rekstad v. US Bancorp, the Tenth Circuit agreed with the district court that the plan's decision to deny benefits was arbitrary. USBancorp has a long history since the Grundhofers took control of discriminatory activities. They have been slammed for involvement in predatory lending practices in inner city areas, for discriminatory lending practices against minorities, for discriminatory hiring and compensation practices with both minorities and women, age discrimination, and there are apparently a number of instances where employees have been denied legitimate disability benefits USB Screws Disabled Employee

Jerry G rakes in $15+ Million of undeserved compensation annually, and he lets his rabies-infected lawyers hound this poor woman into the ground. There is no excuse for this kind of behavior; not towards a customer, and especially not towards an employee. USBank used its muscle to play legal games and prevent her from getting her rightful benefits. It had nothing to do about whether her claim was righteous, and all about USBank's lawyers being able to use legal tricks to block her in court. The only amazing thing is that she had the courage and strength to keep coming back and taking on USBank's sleazy lawyers...I've been leaning towards the belief that Jack and Jerry Grundhofer are just mobsters in bankers' clothing. What's Happening Here??? Jerry Grundhofer is paid to know what is going on in his company, and to take responsibility for everything that happens in his company. If he doesn't or won't, then he can join Ken Lay and Bernie Ebbers in the halls of corporate disgrace

In this case US Bank is the plan administrator and they go over the cases with ITT Hartford making the decisions to deny the disability payments. They have the authority to say who and when the insured should be paid. That is why the judge found USBank guilty of conflict of interest... "I find a conflict of interest exists, an inherent conflict in interest exists if the defendant (USBANK) is both the administrator and the insurer of the disability plan  Confusion!

FYI, this is not round one on the legal case Rekstad VS USBANK. This case has been in appeal 3 times and US Bank lost everyone... I hope you do not work for US Bank because you will not have the support I had to withstand 10 years of abuse.... If you think you, as an employee, matter one iota to Grundhoffer you will be sadly kicked in the stomach just like I was Unusual activity on the board

To continue the abuse of US Bank, On the last possible day in March 2005, USBANK filed another appeal to continue denying its responsibility to its employee, Denise Rekstad....How many more years is this evil going to continue? Confusion! 

Is Grundhoger a front for the mafia? Is he trying to force employees to stop using their benefits? This seems like criminal behavior to me. I think the stockholders should ask for an investigation into the dealings of the Rekstad case criminal background should be checked

Why not pay? USBank took the risk to self insure and now they don't pay because ERISA protects them from only having to pay back wages and expenses. The bank usually makes money on the amount owed until they have to pay. Unfortunately there are other people getting hurt because they don't give a damn thank you

Grundhoggers have been know to disciminate. Look at their history. Maybe Rekstad fits the bill of a women and an AMERICAN INDIAN, Which is at the top of the Grundhogder hate list. US BANK did not have one women branch manager at the time Rekstad was an employee and it is well known Grundhoggers did not approve of the American Indian freedom of rights movement  Known dislike

What on earth could you have against a women who worked for the bank this site is set up for? Is it that her abuse by USBANK is embarrassing for you as an employee or do you agree with abuse and discrimination by an employer to employee USB Screws Disabled Employee

In regards to Ms. Rekstad's case, what U-Skank Bank has is a culture of "make as much as you can for yourself, as fast as you can, and screw everyone else" USB Screws Disabled Employee

Apparently, employees were led to believe that they were buying an insurance policy from Northwest Mutual or ITT, when in fact no such policy existed; it was USBank that extended the coverage as a self-insured entity (that would be mis-represnetation and fraud in most locales) Confusion!
